PRODUCT AVAILABILITY AND DELIVERY TIMES

The available products offered on av08-paris.fr are considered to be in stock. Our product offers and prices are valid as long as they are visible on the site, while stocks last

  

SHIPPING

Shipping costs vary depending on the destination of the package according to the Colissimo & Chronopost rates. Deliveries are made to the address indicated in the order form.

 

Delivery is subject to the following conditions :

  • vou are responsible for the package once the delivery is made,
  • you must inspect the products within a reasonable time after receipt and you are required to accept the product, unless you have notified us within thirty (30) days after receipt that the products are refused.
  • Delivery times are given as an indication only.

In the case of a delivery made by the Post Office, if the package arrives open and/or damaged, we invite you to refuse it. If you decide to accept the goods, you must write down detailed handwritten reserves on the anomaly found and fill in a statement of anomaly as required by the regulations of the Post Office. This form must be sent to us so that we can open an investigation and start a compensation procedure, if necessary.

If you refuse the goods, in addition to the handwritten reserves, you must ask the carrier that the package be returned to us, accompanied by a report which we encourage you to keep a copy.

     

MODALITY OF PAYMENT

Payments are made by credit card, Paylib or Master pass.

We accept the following cards :

The buyer's account will be debited after validation of the order at the rate of the products ordered.

  

RETURN OF PRODUCTS

Products purchased online on av08-paris.fr, unused and in their original packaging, can be returned for a refund within thirty (30) days from the date of delivery, without having to justify your reasons or pay any penalties.

Once this period has expired, you no longer have this right of withdrawal. When this period expires on a weekend, holiday or day off, it is extended until the next business day.

Returns will be reimbursed to you in the same way as you paid for them, once they have reached us.

Please allow ten (10) days from receipt of your return for the refund to appear on your statement. To receive another item to replace your returned item, please send us a message at Contact Us.

SECURITY AND CONFIDENTIALITY

The security and confidentiality of your data are priorities for AV08 Paris. The banking data you enter is instantly encrypted on your computer before being sent to us (thanks to "SSL" encryption technology).

To track your preferences and the products you place in your shopping cart, we use "cookie" technology. These are small text files stored by your web browser on your hard drive. These files can be deleted between orders.

All of the information in your account is used only for the purpose of your business relationship with av08-paris.fr. This information is never shared with third parties or resold. Finally, your banking information is never in our possession.

  

WARRANTY

In accordance with articles L.211-4 to L.211-11 of the French Consumer Code, you benefit from a guarantee against defects in conformity of products purchased on our site. The warranty applies provided that the defect exists at the date of acquisition and allows you to act within two (2) years from that date. The lack of conformity is presumed to exist within six (6) months from the date of acquisition.

To be in conformity with your order, the good must correspond to the description given on our site and have the qualities presented or present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling.

In this case, it is advisable to report the defects to us in writing, by e-mail to hello@av08-paris.fr or by post to the following address AV ACCESSOIRES, Customer Service, 10 rue Coypel, 75013 Paris, France, and return the product(s) to us. If the lack of conformity is confirmed, we will exchange or repair the product according to the cost that this represents in accordance with Article L.211-9 of the French Consumer Code.

  

In accordance with article L.211-11 of the French Consumer Code, the cost of return will be reimbursed to you, upon proof, after the return of your product if the lack of conformity is confirmed. You are therefore invited to keep the receipts of your returns. Otherwise, if you do not attach your receipts, you will be reimbursed at the basic postal rate for the delivery of a package.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

In accordance with Article 1641 of the Civil Code, the seller is also responsible for the guarantee due to hidden defects of the thing sold that make it unsuitable for the purpose for which it was intended, or that reduce this use so much that the buyer would not have acquired it, or would have given only a lower price, if he had known them.

The consumer must prove a latent defect, prior to the sale and preventing the use of the product.

The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

Once the time limits for recourse under the legal warranty of conformity and the warranty of hidden defects have expired, the items will be deemed to be in conformity and free of any apparent or hidden defect and no claim can be validly accepted by AV08 Paris.

AV08 Paris cannot be held responsible for the misuse and/or intensive use of the items by the customer.

Similarly, AV08 Paris shall not be held responsible for the return of a competing product and/or one not sold on the Site by the Customer. It is the Customer's responsibility to return the correct item.

 

INTELLECTUAL AND INDUSTRIAL PROPERTY

All illustrations, images, fonts, presentation modes, graphics and characters on the Site are and remain the exclusive property of AV ACCESSOIRES or the holders of said rights having granted a right of exploitation to av08-paris.fr. Any reproduction, representation or use of said rights by a Customer will constitute a fault giving rise to legal proceedings.

  

RESPONSIBILITY

AV ACCESSOIRES is not responsible for the content and operation of the sites linked to this site, nor for any damage of any kind that may be suffered by the visitor during a visit to these sites.

Use of this Site implies the visitor's knowledge and acceptance of the characteristics and limitations of the Internet and related technologies, the lack of protection of certain data against possible misuse or hacking and the risk of contamination by any viruses circulating on the network. AV ACCESSOIRES declines all responsibility for any misuse or incident related to the use of the computer, Internet access, maintenance or malfunction of servers, telephone lines or any other technical connection, and for sending forms to an incorrect or incomplete address, any computer errors or defects noted on the site.

APPLICABLE LAW

This site is subject to French law.

    

INFORMATION TECHNOLOGY AND FREEDOM, PERSONAL DATA

The Customer is informed and agrees that his or her personal data may be collected on the Site and used by av08-paris.fr which acts as a controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "General Data Protection Regulation" or "GDPR").

  

AV ACCESSOIRES is committed to protecting and ensuring the security and confidentiality of its Customers' personal data in accordance with the GDPR, in particular by taking all necessary precautions to prevent such data from being distorted, damaged or accessed by unauthorized third parties.

  

In particular, the personal data of Customers may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the RGPD, intervene and contribute directly to the management of orders and for whom it is absolutely necessary to have access to the personal data provided by the Customer during the creation and use of his/her account (identity, postal address, telephone number, e-mail address). Subcontractors may only act on instructions from AV ACCESSOIRES.

Customer personal data is collected for the following purposes :

  1. management of orders and relations with Customers,
  2. informing Customers of offers and commercial information related to the brand
  3. to reinforce and improve the communication of the site and the brand by sending, in particular, newsletters and special offers according to the Customer's preferences noted on the site
  4. proposing offers that correspond to preferences identified through browsing data (placing in the basket, abandoned basket, purchase history)
  5. to improve and personalize the services offered to customers,
  6. to comply with legal and regulatory obligations. 

The Customer's personal data is kept only for the time strictly necessary to achieve the above-mentioned purposes. In accordance with the RGPD, the Customer has a right of access, rectification and opposition to personal data concerning him (hereinafter the "Data-processing and Freedom Rights").

  

To exercise one or more of the Customer's rights under the Data Protection Act, the Customer must send a request by e-mail or by mail to the AV ACCESSOIRES customer service department, by filling out the contact form located on the Site, by sending an e-mail to hello@av08-paris.fr or by writing to the following address, indicating the Customer's first and last name, e-mail address and customer references AV ACCESSOIRES, 10 rue Coypel, 75013 Paris. Each request must be signed and accompanied by a photocopy of an identification document bearing the Customer's signature and specify the reply address. The answer to the request exercised on the basis of one or several Data-processing Rights and Freedoms will be addressed within 1 month following the reception of the request.

The Customer may provide AV ACCESSOIRES with specific instructions in which he or she defines the manner in which he or she intends the Data Protection Rights to be exercised after his or her death in accordance with the GDPR.

AV ACCESSOIRES may send customers information relating to the brand's products and commercial offers by mail, email, text message, telephone or via all of the web spaces managed by AV ACCESSOIRES on social networks, subject to prior acceptance.

The customer may at any time object to these commercial prospecting mailings at no cost, by clicking on the "unsubscribe" link in each commercial email, by making a request to customer service via email to hello@av08-paris.fr by unchecking the newsletter registration box in his or her Personal Information on the site.

  

PRICES

For sales within the European Union, the prices listed in the catalog are inclusive of VAT in euros, taking into account the VAT applicable on the date of the order; any change in the rate may be reflected in the price of products or services.

AV ACCESSOIRES reserves the right to modify its prices at any time, it being understood, however, that the price listed on the site on the day of the order shall be the only price applicable to the purchaser.

The prices indicated include order processing costs, but not shipping and delivery costs.

 

In case of order towards a country other than metropolitan France, you are the importer of the concerned products.

  

Please note that for all products shipped outside the European Union and French overseas departments and territories, customs duties, local taxes, import duties or state taxes may be required. These duties and taxes are not the responsibility of AV08 Paris. They will be at your expense and are your sole responsibility in terms of declaration and payment to the relevant authorities and organizations in your country.

You will only be entitled to a refund of the French VAT corresponding to the product(s) ordered if you meet the conditions required to benefit from a tax refund.

If you are a VAT-registered entity in another EU member state and you use the products purchased for your taxable activity, you should be able to reclaim the VAT charged by av08-paris.fr subject to compliance with the conditions set forth in the relevant European VAT Directives.

In all cases discussed, this description assumes that the product is actually shipped to the buyer's home address.

  

RIGHT TO REFUSE ORDERS

AV ACCESSORIES reserves the right to refuse any order or cancel any purchase for any reason.

We also reserve the right to cancel any purchase (an order we have already accepted) in the following situations (among others), without being liable for any damages or charges :

  1. the product is not available / in stock (any payment will be refunded).
  2. the bank details are incorrect or not verifiable;
  3. the order has been detected by our security systems as an unusual order or likely to be a fraudulent act;
  4. the price of the product(s) was incorrect;
  5. it was not able to deliver the package to the address indicated.

    

UNIQUE IDENTIFIER (IDU)

AV ACCESSOIRES, in compliance with French regulations, has the unique identifier FR248145_01CMVF. This identifier is part of the Anti-Waste for a Circular Economy (AGEC) law. This law aims to make all companies, which put products and their packaging on the French market, participate in the financing and efforts to reduce and manage waste.
